Suggestions to change content of ToS[edit source]

change from:

to:

We can technically speaking prevent people from accessing the site (based on ip) but don't really see a need to. People agree to the terms by accessing the site. About disturbing content[edit source]

Hello, my community on Wikia thinks this is a great website and we wish to transfer here, but as a satyrical wiki we're afraid your ToS could prevent us from publishing content someone would deem as offensive or otherwise unsettling, such as profanity, sex, gore, sexism, racism, mockery, controversial political ideas or social trends, etc. We don't post much content like that but enough to raise some eyebrows.

Some typical examples of our most controversial content (not as much as we wished to, thanks to Wikia's censorship) would be (WARNING!): Porco Dio, a gif with a woman kicking a naked man down there, pic of a bloody death, Bambino morto, a pic with a fake newborn cooked into soup, a fake pic with a kid sucking Angelina Jolie's breasts, Caccia al negro, Anna Frank, not to mention articles about recent tragical deaths, that outraged many people, or articles about politicians or other VIPs that threatened to sue us and somehow managed to delete/block our content.

So, if we post content like that or worse (but not real child pornography nor personal infos about random non-famous people, that's taboo):

  • Will you delete/block it, maybe without discussing first (like Wikia does)?
  • Will you always assume the accuser is right and we are wrong (YouTube-style)?
  • In case some lawyers sends a threatening letter (most likely from Italy) or worse, are we somehow protected by the servers being in California/Netherland?
  • Did something like that ever happen to you (any wiki), and how did you deal with it?

But she did not delete them from Miraheze.
  • I have read Miraheze policy that bothered me, because it always offends me to assert that one person's claim to be offended justifies restricting someone else's expression. However, Terms of Use was either not what I read, or the subjective stuff has been removed since I read it.
  • In general, Miraheze should draw bright lines between acceptable and unacceptable conduct, brighter than that someone claims he was offended by it.
  • I don't like content designed to offend, because I believe that growth of a repository of information depends on serving the reader, rather than having the author amuse himself by offending the reader. This might not be a general rule, but it was my rule on Uncyclopedia, and as you have come here to write comedy too, it could guide you too.
  • Miraheze sometimes does not resolve disputes clearly. When it does so, it does so by consensus. Posting to a talk page of a policy page tends not to get measurable consensus, as debate is limited to those who stumble across it. I suggest opening a page in the Forum.
  • Don't get me started on Sannse at Wikia. At least her Wikia job keeps her from doing the same things in the California legislature.

We might delete/suppress/block/do anything necessary as we see fit, to protect us, users, or someone else. For example, List of globally banned users (incomplete) contains some of the people banned by decree.
Terms of Use#7. Content says you are not allowed to post anything that is illegal on California, United States and the Netherlands.
We don't assume one party is always right. However it does not mean we will always discuss with the community.
We have wiki-abuse@miraheze.org to process such requests. I can't talk about the details of other cases to protect relevant people's privacy.

Thanks, but we need to know what might happen if someone (likely from Italy) protests because we have an article making fun of dead babies (in a very surreal way, it's just dark humor), or a BDSM gif in an article about relationships, or an article about the sport of hunting black africans (again, dark humor), or a (obviously) fake new about some VIP. We don't really need any detail about actual cases, just a clear "that's not ok" so we know we must find alternatives, also because we can't hire a lawyer just to know how much the state of California and Netherland allow free satire, dealing with italian laws is already complicated enough.--Wedhro (talk) 17:41, 3 June 2018 (UTC)Reply[reply]
We have a precedent out of England (so it doesn't reflect either on your Uncyclopedia or on Miraheze); it seems to be legal to teach your dog to give the Nazi salute when you shout, "Sieg Heil!" but not to publish it doing so on YouTube. I am strongly on the other side. Without being a Nazi supporter, this is outrageously funny because of the reader's outrage. Kiddie porn, yes, there's nothing funny about it and any web host has a duty to turn you in. Wikia has waged jihad on Uncyclopedia with nipples and butt-cracks, even in satire 'shoops of photos of historical significance.
Miraheze ought not violate other users' privacy to publish "case law," but neither should it ask users to learn the law of California. Clear statements of what will be allowed are in everyone's interest.

Hi, I'm Miraheze's policy expert, at least on legal things. I'm also something of a satirist, having been a principal member of the Students for an Orwellian Society in university (because 2018 is 34 years too late!). Both Netherlands and U.S. freedom of speech law is very strong, so there's not much in legal terms that limits your site. Basically, don't encourage a different crime, or cause anyone harm. Otherwise, say what you will. Content Policy has examples of illegal content. It also has the much fuzzier "must not create problems" part. Ultimately, Miraheze is a volunteer effort on a very small budget. What that really means is, we believe in free speech, but we also believe in server uptime, and there's a point beyond which we do not have the resources to fight to keep things online. That said, this looks like Uncyclopedia bullshit. That's basically fine. It's Encyclopedia Dramatica that we don't want to host. Who owns the content of a wiki?[edit source]

The rules are way too firm[edit source]

I think that users of any age of any race of any religion of any nationality can join and edit this wiki. Additionally, my wiki allows anyone to copy material without my permission.
